This Prohibited Products Policy applies to all vendors, sellers, users, and listings on PCC Auto Parts Marketplace (“Marketplace,” “we,” “us,” or “our”) at https://pccautoparts.com/.
PCC Auto Parts Marketplace is a multi-vendor platform for automotive parts, accessories, performance products, and related items. To protect the marketplace, customers, vendors, and the public, certain products and listings are strictly prohibited.
By using the website, registering as a vendor, listing products, or selling through the marketplace, you agree to comply with this Prohibited Products Policy.
1. General Rule
Vendors may only list and sell products that are lawful, authentic, safe, accurately described, and permitted under marketplace rules.
PCC Auto Parts Marketplace reserves the right to remove, suspend, restrict, reject, or delete any listing, product, vendor account, or transaction at any time, with or without notice, where we believe a product may be prohibited, unsafe, misleading, unlawful, or otherwise unsuitable for the platform.
2. Prohibited Products
The following products, categories, and listings are prohibited from being listed, advertised, offered, or sold on the marketplace unless we expressly approve them in writing.
a. Illegal Products
Any product that is illegal to possess, advertise, distribute, import, export, or sell under applicable law is strictly prohibited.
b. Counterfeit, Fake, or Unauthorized Goods
Products that are counterfeit, fake, pirated, unauthorized, unlawfully branded, imitation, or otherwise infringe intellectual property rights are prohibited.
This includes:
- counterfeit branded auto parts,
- fake logos or packaging,
- unauthorized brand replicas,
- copied or pirated manuals,
- unlawfully reproduced product materials.
c. Stolen Goods
Any stolen goods, unlawfully obtained property, or products offered without lawful ownership or authority are prohibited.
d. Unsafe or Defective Products
Products that are known to be unsafe, dangerously defective, recalled, contaminated, expired, or unfit for sale are prohibited.
This includes products that may pose unreasonable risk to vehicle safety, public safety, or personal injury.
e. Recalled Products
Any product subject to a manufacturer recall, government recall, safety recall, or stop-sale notice is prohibited unless the recall has been fully resolved and the product may lawfully be sold.
f. Products That Violate Road Safety or Regulatory Requirements
Products that violate applicable vehicle safety, emissions, road-use, inspection, environmental, or transportation laws are prohibited where unlawful.
g. Hazardous Materials
Hazardous, flammable, explosive, corrosive, toxic, biohazardous, radioactive, or otherwise dangerous materials are prohibited unless expressly approved by us in writing and fully compliant with all shipping and legal requirements.
This may include, without limitation:
- explosives,
- dangerous chemicals,
- improperly packaged flammable liquids,
- certain batteries,
- compressed gases,
- hazardous waste.
h. Weapons and Weapon-Related Products
Weapons and weapon-related products are prohibited, including but not limited to:
- firearms,
- ammunition,
- explosive devices,
- weapon conversion components,
- prohibited defensive devices where unlawful.
i. Drugs, Controlled Substances, and Illegal Consumables
Illegal drugs, controlled substances, unauthorized pharmaceuticals, drug paraphernalia, or unlawful consumable products are prohibited.
j. Adult, Offensive, or Obscene Products
Products containing obscene, unlawful, exploitative, or highly offensive material are prohibited.
k. Fraudulent or Misleading Products
Any product listing that is deceptive, misleading, falsely advertised, materially inaccurate, or intended to defraud customers is prohibited.
This includes listings with:
- false fitment claims,
- false brand claims,
- false warranty claims,
- false condition statements,
- manipulated photos,
- hidden defects,
- bait-and-switch practices.
l. Products Without Legal Right to Sell
Vendors may not sell any product they do not lawfully own, control, source, or have authority to distribute.
m. Infringing Intellectual Property
Products or listings that infringe copyright, trademark, patent, trade dress, trade secret, or other proprietary rights are prohibited.
n. Non-Automotive Products Outside Marketplace Scope
Products that are unrelated to the automotive, auto-accessory, or closely related vehicle category may be removed at our discretion.
o. Used Products Not Properly Disclosed
Used, refurbished, remanufactured, open-box, damaged, or salvage products that are not clearly and accurately disclosed as such are prohibited.
p. Odometer, Emissions, Safety, or Regulatory Tampering Products
Products intended to unlawfully alter, bypass, disable, tamper with, or defeat odometers, emissions systems, safety systems, diagnostic systems, or legal compliance systems are prohibited where unlawful.
q. Stolen Vehicle Access or Security Circumvention Tools
Products primarily intended to unlawfully bypass vehicle security, access control, immobilizers, locks, tracking systems, or anti-theft systems are prohibited unless clearly lawful and expressly approved.
r. Human Body Parts, Personal Data, or Other Clearly Inappropriate Items
Any clearly inappropriate, unlawful, or unrelated listing may be removed at our discretion.
3. Restricted Products
Certain products may be restricted rather than fully prohibited. PCC Auto Parts Marketplace may require prior approval, additional verification, documentation, or category-specific rules before allowing the sale of certain products.
We reserve the right to determine, at our sole discretion, whether any item is allowed, restricted, or prohibited.
4. Vendor Responsibility
Each vendor is solely responsible for ensuring that all listed and sold products:
- comply with applicable laws,
- comply with marketplace rules,
- are safe and lawful,
- are authentic,
- are accurately described,
- do not infringe third-party rights,
- can be legally shipped and sold,
- are legally permitted in the jurisdictions targeted by the vendor.
5. Listing Removal and Enforcement
If we believe that a product or listing may violate this policy, we may take action including:
- refusing publication,
- removing the listing,
- hiding the product,
- suspending the vendor account,
- withholding access to marketplace tools,
- canceling transactions where permitted,
- reporting the matter to relevant parties or authorities where appropriate,
- permanently terminating the vendor account.
We are not required to provide advance notice before taking action.
6. No Obligation to Monitor
PCC Auto Parts Marketplace may review listings, but we are not obligated to pre-screen, monitor, approve, or verify every product, vendor, or listing. The presence of a listing on the website does not mean that we approve, verify, or guarantee it.
7. Reporting Prohibited Products
If you believe a listing or vendor is offering a prohibited, unsafe, infringing, or unlawful product, you may report it to us for review.
8. Indemnification
Vendors agree to indemnify, defend, and hold harmless PCC Auto Parts Marketplace and its owners, operators, affiliates, officers, employees, contractors, and agents from and against any claim, liability, damage, loss, cost, fine, penalty, or expense arising out of or related to any prohibited, unlawful, unsafe, infringing, or misrepresented product listed or sold by the vendor.
9. Policy Changes
We may update this Prohibited Products Policy at any time by posting the revised version on the website. Continued use of the website after changes are posted means you accept the updated policy.
